Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Solar Fleet (the “Service”), operated by Solar Fleet (“we”, “us”) from Cape Town, South Africa. By creating an account or using the Service, you agree to these Terms.

1. The Service

Solar Fleet is a read-only multi-vendor solar fleet monitoring dashboard. It aggregates monitoring data from third-party inverter platforms (e.g. Victron VRM, Sunsynk Connect, Deye Solarman, Huawei FusionSolar) into a single view, and provides alerts on conditions you configure. The Service does not control your inverters, push firmware updates or issue commands to your hardware.

2. Your account

• You must be at least 18 years old and authorised to enter into these Terms on behalf of yourself or the company you represent.
• You are responsible for everything that happens under your account. Keep your password confidential and notify us immediately if you suspect unauthorised access.
• You agree to provide accurate company and contact information and to keep it up to date.
• The account owner can invite additional users and assign roles (owner, admin, viewer).

3. Vendor accounts and credentials

To use the Service you will provide credentials for one or more inverter vendor platforms. You represent that you have the right to authorise our access to those platforms on behalf of the relevant site owners. You acknowledge that:

• We store these credentials encrypted at rest and use them only to poll monitoring data on your behalf.
• We are not responsible for the availability, accuracy or behaviour of the third-party vendor platforms themselves.
• Some vendor platforms charge per API call or impose rate limits; the Service respects published limits but is not responsible for any charges levied by the vendor against your vendor account.

4. Subscriptions, trials and billing

• The Service is offered on a monthly subscription, billed in South African Rand.
• New accounts receive a 14-day free trial. No credit card is required to start the trial.
• To continue using the Service after the trial ends, you must subscribe to a paid plan via our payment processor, PayFast.
• Subscriptions renew automatically each month until cancelled. You can cancel at any time from the Billing screen; cancellation takes effect at the end of the current billing period.
• Fees are non-refundable except where required by law.
• We may change prices on 30 days' written notice. Existing subscriptions are honoured at the old price until the next renewal.

5. Acceptable use

You agree not to:

• Use the Service in violation of any applicable law or regulation.
• Attempt to access another tenant's data, reverse-engineer the Service, or interfere with its operation.
• Resell, sublicense or white-label the Service without our written consent.
• Upload credentials you are not authorised to use, or that you obtained without consent.
• Use the Service to attack, scan or otherwise abuse any third-party system, including the vendor platforms we integrate with.

6. Intellectual property

The Service, including its design, source code, documentation and trademarks, is owned by us. We grant you a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms while your subscription is active.

You retain ownership of the data flowing through the Service (your sites, vendor data, configuration). You grant us a licence to process this data solely to provide the Service to you, subject to our Privacy Policy.

7. Confidentiality

Each party agrees to keep the other's non-public information confidential and to use it only to perform under these Terms. Vendor credentials, customer site lists and aggregated production data are treated as your Confidential Information.

8. Service availability

We work hard to keep the Service available, but we do not promise uninterrupted access. Polling cadence and vendor-data freshness depend on the third-party vendor platforms. We will give reasonable notice of planned maintenance. We do not offer a contractual uptime SLA on the published plans; if you need a written SLA, contact us about an enterprise agreement.

9. Termination

• You may cancel your subscription at any time from the Billing screen.
• We may suspend or terminate your account if you breach these Terms, fail to pay, or use the Service in a way that endangers other users or our infrastructure. We will give reasonable notice where practical.
• On termination, your access ends, your data is retained as described in the Privacy Policy, and you remain liable for any unpaid fees up to the termination date.

10. Disclaimers

The Service is provided “as is”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. The Service is a monitoring tool and is not a substitute for periodic on-site inspection or independent verification of equipment status.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, consequential, special or punitive damages, including loss of revenue, lost production or equipment damage arising from a failure of the Service to detect or report a condition. Our total cumulative liability under these Terms is limited to the fees you paid us in the three months preceding the claim.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. The parties submit to the non-exclusive jurisdiction of the Western Cape High Court for any dispute that cannot be resolved by good-faith negotiation.

13. Changes

We may update these Terms from time to time. Material changes will be communicated by email to account owners and surfaced at the top of this page. Continued use after a change takes effect constitutes acceptance.
